Terms of Service

By accessing or using the Gomini website (gomini.in) or any service of Gomini Innovation Private Limited (“Gomini”), you agree to these terms. If you do not agree, please do not use the site or our services.

1. About Gomini

Gomini is a partner-led puja-samagri operations platform. Gomini does not currently operate as a public online marketplace or a direct-to-home e-commerce service. Products and services are made available exclusively through Gomini's partner pandits, retail partners and experience centres.

2. Use of this website

This website is for informational purposes, lead capture and partner engagement. You may use this site to learn about Gomini, register your interest in our services, apply for partnership, and contact us.

You agree to use this site only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use and enjoyment of, this site by any third party.

3. Partner relationships

Gomini works with pandits, retailers, distributors and other partners under separate partnership arrangements. These terms govern your use of the website; specific partnership terms are agreed individually with each partner.

4. Communications

By submitting a form on this site or engaging with Gomini through any communication channel (including WhatsApp, where applicable), you consent to being contacted by Gomini regarding your inquiry, service request or partnership.

Gomini uses WhatsApp for approved customer and partner communications. WhatsApp interactions are subject to WhatsApp's own terms and policies in addition to these terms and our Privacy Policy.

4a. WhatsApp Business API - partner obligations

Where Gomini provides WhatsApp Business API access or integration services to a partner, the following additional terms apply:

  • (a) The partner agrees to comply with Meta's WhatsApp Business Terms of Service (business.whatsapp.com/policy), Meta's Commerce Policy (facebook.com/policies/commerce), and any other Meta platform policies applicable to WhatsApp Business API usage.
  • (b) The partner is the data controller for end-user data processed via their WhatsApp Business Account. The partner is responsible for maintaining their own privacy policy and obtaining any consents required under applicable law before messaging their users.
  • (c) The partner must not use the WhatsApp Business API integration provided by Gomini for any purpose prohibited under Meta's policies or these Terms (see Section 7a below).
  • (d) Gomini reserves the right to suspend or terminate a partner's API access immediately if Gomini reasonably believes the partner is in violation of Meta's policies or these Terms, without liability to Gomini.

5. Intellectual property

All content on this site - including text, images, the Gomini Gayatri Framework, module descriptions, journal articles, design elements and brand marks - is the intellectual property of Gomini. Reproduction, distribution, or use without prior written permission is prohibited.

6. Form submissions and data

By submitting information through this site, you represent that the information you provide is accurate. See our Privacy Policy for details on how we handle your data.

7. Appropriate use

You agree not to:

  • Use this site or Gomini's services for any unlawful or fraudulent purpose.
  • Submit false, misleading or spam information through any form or communication channel.
  • Attempt to gain unauthorised access to any part of the site, its systems or databases.
  • Interfere with or disrupt the operation of the site.
  • Reproduce, scrape or redistribute site content without permission.

7a. Prohibited use of WhatsApp Business API

Partners and users accessing Gomini's WhatsApp Business integration expressly agree NOT to use it for:

  • Sending unsolicited bulk messages, spam, or marketing messages to recipients who have not opted in.
  • Sending content that is illegal, fraudulent, defamatory, obscene, or violates any applicable law.
  • Political campaigning, electoral advertising, or advocacy messaging.
  • Adult content, gambling, or regulated financial products, unless explicitly approved by Meta and Gomini in writing.
  • Circumventing Meta's rate limits, messaging policies, or template approval requirements.
  • Impersonating any person, business, or brand.
  • Any activity that violates Meta's WhatsApp Business Terms of Service or Commerce Policy.

Gomini will terminate access to the WhatsApp integration for any partner found in violation of this section, and may report the violation to Meta.

8. Suspension and termination

Gomini reserves the right to suspend or terminate access to the site or any service, and to refuse future service, to any user or partner who violates these terms or engages in conduct that Gomini reasonably considers harmful, abusive or disruptive.

9. Limitation of liability

This site and its content are provided “as is” without warranties of any kind, express or implied. Gomini makes no warranties regarding the completeness, accuracy or reliability of information on this site. To the fullest extent permitted by law, Gomini shall not be liable for any indirect, incidental, special or consequential damages arising from your use of or inability to use this site or our services.

10. Third-party links

This site may contain links to third-party websites. Gomini does not control and is not responsible for the content or practices of those sites.

11. Changes to these terms

We may update these terms from time to time. Material changes will be indicated by updating the date below. Your continued use of our site or services after changes are posted constitutes acceptance of the updated terms.

12a. Indemnification

You agree to indemnify, defend and hold harmless Gomini, its directors, officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of this site or Gomini's services in violation of these Terms.
  • Your violation of any applicable law or third-party rights.
  • Your misuse of WhatsApp Business API access provided by Gomini.
  • Any claim by a third party (including Meta Platforms, Inc.) arising from your WhatsApp messaging activities.

12b. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Araria, India.
